National Social Security Council
The National Social Security Council (CNSS) ordered the Superintendence of Health and Labor Risks (SISALRIL) to pay 14 weeks of contributable salary to female workers affiliated to the Contributive Regime of the Dominican Social Security System (SDSS), who qualify for the Maternity Allowance.
The entity in an ordinary meeting held this Thursday, March 30, issued Resolution No. 418-02 which provides for compliance with the provisions of Convention No. 183, adopted by the International Labor Organization (ILO) in Geneva, Switzerland, on Maternity Protection 2000 and approved by the National Congress through Resolution No. 211-14.
"This ILO convention provides for a two-week increase in maternity leave, that is, an increase from 12 to 14 weeks, which means that mothers have more time to care for their children and this implies better coverage," according to CNSS general manager Rafael Pérez Modesto.
The official pointed out that with this resolution the Council is complying with this agreement to which the country is a signatory, while demonstrating the operability of the System's governing body and the gradual strengthening of social security.
He pointed out that the resolution establishes that the ILO convention modifies Art. 132 of Law 87-01 and Art. 6 of the Regulation on Maternity and Lactation Allowance, as well as any other legal provision that is contrary to it.
The provision instructs SISALRIL to submit a report to the CNSS every six (6) months, showing the development and financial impact resulting from the application of this resolution, which will become effective immediately.
The CNSS with this resolution complies with the provisions of Article 74 of the Constitution of the Republic, in relation to the principles of regulation and interpretation, treaties, covenants and conventions relating to human rights, signed and ratified by the Dominican State, which have constitutional hierarchy and are of direct and immediate application by the courts and other organs of the State.
